Terms and Conditions

Thank you for your interest in the Vodacom Domain Name Registration Service for Small to Medium Enterprises ("the service")

Vodacom (Pty) Ltd and its affiliates ("Vodacom") have worked in collaboration with Google Ireland Ltd ("Google"), to provide the service and related tools and services posted at www.wozaonline.co.za. We hope you enjoy using them.


The criteria for the the service offering is as follows:

(a) Only applicants who are Small to Medium Enterprises ("SMMEs") qualify to register on the Woza domain registration website provided by Vodacom ("the WO custom domain registration website") pursuant to the service offering. For clarity, "SMMEs" are defined and understood to be small to medium business enterprises who employ 1 to 100 individuals and which carry on business in the Republic of South Africa;

(b) The WO custom domain registration website is only available to applicants which have built and created their websiteutilising the Google Sitebuilder Tool;

(c) The WOcustom domain registration website is only available to successful applicants and is subject to the terms and conditions set out hereunder.


Vodacom reserves all rights with regard to all aspects of the service and have the sole and absolute discretion in determining whether an applicant has met the criteria.


1. These terms and conditions are a contract between you and Vodacom and apply to your use of the www.vodacombusiness.co.za/wozadomain_register site. They do not apply to your use of any other services offered or provided Vodacom or Google. You will be deemed to have accepted them if you use any of the services offered through the www.vodacombusiness.co.za/wozadomain_register site.


2. The key features of the service through the www.vodacombusiness.co.za/wozadomain_register site, is the ability for you as a successful applicant to:

2.1 set up a .co.za customised domain for the use of your business; this service is offered by Vodacom and is subject to the charge set out below; and

2.2 associate that domain with a website address setup through the service site which includes the Google Sitebuilder Tool.


3. Your use of services provided by other partners will be solely governed by the terms and conditions of use of other partners. Neither Vodacom nor Google are responsible for providing these services to you, and you will need to check in each case that you are happy with the service and the terms and conditions of service of other partners before using those services. 5. If you opt in, you will receive a customised domain on the custom domain registration website for a period of 12 months, subject to the payment of the annual fee of R100.00 (exclusive of Value Added Tax), which is payable in advance . After 12 months, Vodacom will offer you the opportunity to enter into a further paid for contract in respect of the domain name service (subject to Vodacom continuing to provide the services beyond the initial 12 months and Vodacomâ¿¿s applicable domain name services, terms and conditions at the time).


6.  Restrictions

6.1  You agree not to:

6.1.1  use your domain name for any purpose other than to promote your business;

6.1.2 sell, transfer or assign your domain name for money or moneyâ¿¿s worth or in any way whatsover, except in the context of selling your business as a going concern;

6.1.3 use any services provided by third party partners, Vodacom or Google in breach of any of the terms and conditions for the use of those services.

 Use of your domain name shall be subect to Vodacomâ¿¿s Acceptable Use Policy, as amended from time to time, posted on www.vodacombusiness.co.za.

 You understand that these terms and conditions may also apply to the services offered by other partners, where they are incorporated into their terms and conditions.


7.  Data protection and privacy

7.1 To the extent permissable by legislation, any data including personal data which you enter the service will be held subject to the Vodacomsâ¿¿ privacy policies.

7.2 Vodacom and Google may, to the extent permissable by legislation, share this information with each other and trusted third parties involved in order to provide the service (including the site you create and the domain name you acquire).

7.3 Vodacom may, if you have given your consent in the service sign up process, contact you to help you benefit from the service and provide information about other products and services that may be of interest to you.

7.4 When you request a customized domain name via the WO custom domain registration website, Vodacom and Google are obliged to provide registrant details to Uniforum Association South Africa ("UniForum") a body which administers .co.za and other South African domains. UniForum will make those details available through a publicly accessible record called a "WHOIS" record, which you can find on the UniForum website.

7.5 The UniForum website is a co-operative effort between Vodacom and Google. This website uses Google Analytics, a web analytics service provided by Google. Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use domain registration sites. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this anonymous user behavior information for the purpose of evaluating your use of the website, compiling reports on website activity for operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, to third party partners or where such third parties process the information on Google's behalf. This means that third party partners will be able to view anonymous user behavior on this site. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

8.  Changes and third party services

8.1 To the extent permissable by legislation, Vodacom reserves the right, in its sole discretion, to change, modify, add, or delete portions of these terms and conditions at any time without further notice. If this happens, the new terms will be posted on the www.vodacombusiness.co.za/wozadomain_register site. Your continued use of the Whoza custom domain registration website , after any such changes constitutes your acceptance of the new terms and conditions.

8.2  To the extent permissable by legislation, Vodacom and Google may change the service and the services offered through it from time to time without liability to you.

8.3  Vodacom does not accept responsibility for or endorse any third party services offered through the service.


9.  Withdrawal of services

9.1  If you use the www.vodacombusiness.co.za/wozadomain_register site or any of the services offered through the www.vodacombusiness.co.za/wozadomain_register site in contravention of these terms and conditions or if you use them against the spirit of the service, the services you are being provided may be withdrawn from you without notice, subject to legislation.

9.2 To the extent permissable by legislation, Vodacom and Google may end or suspend service at any time at their sole discretion without any liability to you. This will not affect the existence of your site.

10.  Monitoring

10.1 Where Vodacom is required to intercept communications in accordance with the provisions of the Regulation of Interception and Provision of Communication-Related Act, 70 of 2003 ("the Monitoring Act"), any interception of communications shall be strictly carried out in accordance with the requirements of the Monitoring Act, as and when required under the Monitoring Act.

10.2  You specifically agree that you shall have no recourse against Vodacom in the event of Vodacom acting in terms hereof and accordingly waive any right to make any claim or demand or to institute any legal proceedings against Vodacom.


11.    Disclaimer Of Warranties

11.1  You acknowledge and agree that the use of the service is at your own risk. Neither Vodacom, Google nor their agents, employees, suppliers, licensors and/or third party content providers ("Vodacom associates") warrant, to the extent permissable by legislation. that the said service will be uninterrupted, error-free, secure, reliable or accurate.

11.2  Save as specifically set out herein and to the extent permissable by legislation, Vodacom and Google make no warranty as to the results to be obtained from the use of the servic and same is made available to you on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including without limitation, warranties of merchantability, fitness for a particular purpose, accuracy or completeness of informational content, non-infringement or otherwise.

11.3  Neither Vodacom nor Google, to the extent permissable by legislation, represent, warrant or guarantee or assume any responsibility for the quality of the service or of the signals or the data transmitted as part of same and shall not be liable for any loss, cost, claim, damage or expense which may be caused by weak signals and/or data lost.

11.4  In addition to the criteria relevant pursuant to registration in terms of the Service the registration of a domain name on the WO custom domain registration website is carried out on a "first come, first served" basis. The registration is based upon the validity and availability of the requested name as per the Registry records. These records will be taken as evidence of the domain name availability and Vodacom and Google will not assume responsibility for any errors or conflicts as a result thereof. Vodacom and Google assume the authenticity and accuracy of the various Registry records and the details in the various registers of the Registry will be treated as correct and as an authoritative record. The "Registry" refers to an organization or commercial entity or their agents, accredited by the Internet Corporation for Assigned Names and Numbers (ICANN) or by a national country code top-level domain (ccTLD) authority, to manage the reservation of internet domain names in accordance with the guidelines of the designated domain name registries and offer such services to the public.

11.5  Vodacom and Google will not become involved (directly or indirectly) in any dispute, between you and a third party, arising out of or pertaining to names services. Where a conflict pertaining to domain name services does arise, those parties must resolve the dispute independently of Vodacom and Google.

11.6 Vodacom and Google assume no responsibility for incorrect spelling, typing inaccuracies and mistakes in registering domain names. It will be assumed that the information provided you is correct and accurate.


12. General

12.1 These terms and conditions will be governed by and construed in accordance with the laws of the Republic of South Africa and you shall submit to the jurisdiction of the South African Courts.

12.2 These terms and conditions are severable, in that if any provision is determined to be illegal or unenforceable by any court of competent jurisdiction, then such provision shall be deemed to be deleted without affecting the remaining terms and conditions.
